Sattler: Decisions of Constitutional Court of BiH are legally binding and final

BIJELJINA, February 13 (FENA) - Head of the EU Delegation to Bosnia and Herzegovina and EU Special Representative, Ambassador Johann Sattler, stressed today that the decisions of the Constitutional Court of Bosnia and Herzegovina are legally binding and final.

Commenting on a decision by RS government officials to suspend their work at the state level in deciding on any matter from the jurisdiction of the BiH authorities, following a recent decision by the BiH Constitutional Court on the RS Law on Agricultural Land, Sattler told reporters in Bijeljina after a two-day economic reform working meeting that not respecting decisions of the BiH Constitutional Court leads to a legal vacuum.

“You must have one final instance in each society and system, an arbitrator, an independent decision-making body. One of the cornerstones is the BiH Constitutional Court in this country, and its decisions are legally binding and final,” he said.

Sattler added that, whatever the decision is, it is legally binding and final.

“Right now, at this moment, we are talking about recent decisons from Banja Luka, but I must emphasize that the rest of the country and the Federation of BiH and the level of BiH do not implement a significant number of earlier decisions of the Constitutional Court. Failure to implement such decisions leads to legal uncertainty and a legal vacuum,” Sattler said.

RS President Željka Cvijanović said yesterday that RS representatives in BiH institutions are suspending work on any issue under the jurisdiction of BiH authorities, pending the adoption of a new law on the Constitutional Court without foreign judges.

At the meeting of Serb officials and representatives of parliamentary parties, they also agreed to convene an emergency session of the RS National Assembly, which could be scheduled for Monday, February 17, in connection with the decision of the Constitutional Court of BiH, which declared Article 53 of the RS Law on Agricultural Land unconstitutional.  

RS officials do not accept the decision and claim it causes "detriment to the RS".
