SARAJEVO, April 10 (FENA) - A member of the BiH Presidency, Denis Bećirović, officially requested from the Chief Prosecutor of the BiH Prosecutor's Office, Milanko Kajganić, information on the legal measures taken against the officials and responsible persons in the institutions of the Republika Srpska entity for non-execution of the decisions of the Constitutional Court of Bosnia and Herzegovina in cases of unconstitutional organization and registration of state property.
Referring to the BiH Criminal Code and the Law on the Prosecutor's Office of Bosnia and Herzegovina, Bećirović said in his request that the RS authorities have not implemented the final and binding decisions of the BiH Constitutional Court, which refer to the unconstitutional organization of the legal matter of state property that is in the exclusive possession and jurisdiction of BiH.
“The lack of sanctioning of unconstitutional and illegal behavior is a kind of stimulating factor for official and responsible persons in the government of the RS entity who attack the achieved values of the rule of law, thus, due to inaction, primarily by the Prosecutor's Office of BiH, as well as other competent bodies of the state, we are witnessing the repetition of unlawful acts on issues on which the BiH Constitutional Court has already decided and made final and binding decisions,” Bećirović’s office said.
He added that the responsible persons in the BiH Prosecutor's Office are legally obliged to ensure the effective exercise of the competencies of the state and respect for legality throughout its territory.
“No one in the BiH Prosecutor's Office has the right to be an accomplice in the anti-Dayton and unlawful activities of certain irresponsible politicians by their inaction,” reads the conclusion of the message of the BiH Presidency member Denis Bećirović.
