Komšić to file Request for Constitutional Review of Residence Law

SARAJEVO, December 24 (FENA) - Member of the Presidency of Bosnia and Herzegovina Željko Komšić will file a request to review to the Constitutional Court of BiH in the coming days regarding the Law on Residence and Stay of BiH Citizens, Komšić's office told FENA.

Namely, Komšić will send a request for review of the constitutionality/compliance of the Law on Residence and Stay of BiH Citizens with the Constitution of Bosnia and Herzegovina, because, as stated in the appeal, violations of the BiH Constitution violated the International Covenant on Civil and Political Rights, economic, social and cultural rights, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the Universal Declaration of Human Rights, the Framework Convention for the Protection of National Minorities and Annex 7 of the General Framework Agreement for Peace in Bosnia and Herzegovina.

Amendments to the Law on Residence and Stay of Citizens of Bosnia and Herzegovina were placed in the parliamentary procedure in 2013 in the Parliamentary Assembly of BiH, after which they were adopted.

“Such controversial legal solutions, in addition to other categories of citizens, especially affected the returnee population and, among other things, the disputed provisions of the said Law served as a means of satisfying ethnic cleansing in the period after their enactment,” Komšić's office told FENA.
