Zvizdić: The election law of RS directly strips away the competencies of the CEC

SARAJEVO, July 17 (FENA) - Deputy Speaker of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina Denis Zvizdić announced via social networks that "as of today, the new Election Law of the entity of Republika Srpska is officially in force, which directly takes away the competences of the state Central Election Commission and which is regulating in an anti-constitutional way a matter that is already prescribed by the state Election Law, which aims to create a parallel legal order".

Zvizdić believes that this is a direct attack on the sovereignty and territorial integrity of Bosnia and Herzegovina because the unified electoral system is a characteristic of a single state.

"In this regard, this morning I submitted to the Constitutional Court of Bosnia and Herzegovina a request for an evaluation of the constitutionality of the Election Law of the RS with a proposal for a temporary measure.

The disputed law directly violated the provisions of the Constitution of Bosnia and Herzegovina that regulate democratic principles, the rule of law system and the provisions of the Constitution of Bosnia and Herzegovina that speak about the obligation of entities to submit to the regulations of Bosnia and Herzegovina and the decisions of the institutions of Bosnia and Herzegovina," he said.

He noted that the previous practice of the Constitutional Court of Bosnia and Herzegovina in the same or similar cases clearly showed that it is an unconstitutional law, and this is argued in great detail in the request for constitutionality assessment.

Due to all of the above, Zvizdić believes that it is obvious that this is an unconstitutional law which, both in its content and in terms of the intention to be achieved, represents a violation of the principle of the rule of law and the principle of respect for the hierarchy of legal norms, because the state cannot exercise its functions if the lower levels of government they interfere in state affairs and regulate them in the way they want, not respecting state regulations.

He reminded that the harmfulness of the implementation of the disputed Election Law of the RS was confirmed by many state and international institutions and organizations, such as the Central Election Commission of BiH, the Office of the High Representative, the Peace Implementation Council in BiH, the US Embassy in BiH, the OSCE and the EU Delegation in Bosnia and Herzegovina.
