SARAJEVO, September 1 (FENA) - Deputy Speaker of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina (PA BiH) Denis Zvozdić submitted to the Constitutional Court of Bosnia and Herzegovina a request for an evaluation of the constitutionality of the phrase "joint institution".
- After the SNSD and HDZ yesterday at the House of Representatives session voted against the Proposal to amend the Law on the Flag of Bosnia and Herzegovina, in which I requested the deletion of the phrase 'joint institution' from this law, I already today submitted to the Constitutional Court of Bosnia and Herzegovina a request for the review of the constitutionality of this wording. I am convinced that it is an unconstitutional term, both semantically and legally. Suffice it to say that the Constitution of Bosnia and Herzegovina mentions only 'institutions of Bosnia and Herzegovina' in as many as 13 places, and not a single place mentions 'joint institutions' - says Zvizdić, explaining the reasons for addressing the Constitutional Court of Bosnia and Herzegovina.
At the same time, he points out that the legal segment is much more important for this appeal, as well as for him personally, "because the use of this wording has very dangerous consequences for the historical-legal continuity, statehood and sovereignty of Bosnia and Herzegovina".
- That is why I stated in the appeal, among other things, that the entities are not 'states', that sovereignty belongs only to Bosnia and Herzegovina, that Bosnia and Herzegovina is not a 'state union', nor was Bosnia and Herzegovina created by a joint agreement of the entities, and therefore cannot there should be 'joint institutions', but only 'institutions of Bosnia and Herzegovina', and that any use of the phrase 'joint institutions' in any official act of any level of government in BiH should be judged as unconstitutional - explains Zvizdić.
He believes that "the goal of those who use the term 'joint institutions' is perfidious and dangerous, because they want to change the character of the statehood of Bosnia and Herzegovina, because the term 'joint institutions' suggests that Bosnia and Herzegovina is a 'state community', which is completely incorrect and wrong. On the contrary, Bosnia and Herzegovina is a complete and internationally recognized state, which has its own sovereignty, territorial integrity, international subjectivity and political independence".
- I am convinced that the Constitutional Court of Bosnia and Herzegovina will make a correct and fair decision and that it will invalidate this provision and declare the phrase 'joint institutions' unconstitutional - said Zvizdić.
