SARAJEVO, December 8 (FENA) - The House of Peoples of the Federation of BiH Parliament should decide tomorrow on the proposed amendments to the FBiH Law on Electricity in FBiH, which creates a precondition for banning the construction of small hydropower plants (SHPPs) as hydropower facilities with installed capacity up to 10 MW (megawatts) on the entire territory of the Federation of BiH.
Article 78 of the Law is amended by the provision of the article suspending the issuance of energy permits for small hydropower plants throughout the Federation of BiH, which prevents the issuance of building permits from any competent institution for issuing building permits for small hydropower plants.
This ultimately results in the impossibility of building or banning the construction of small hydropower plants.
Another provision in Article 116 of the Law was added in order to enable all applicants who have concluded contracts with the competent authorities on the awarding of a concession by the time this law enters into force are exempted, provided that they are obliged to complete the application for the issuance of an energy permit within three years, all for the purpose of avoiding litigation between investors and government agencies.
The deadline of three years was left due to the fact that the applicant is obliged to obtain certain documentation, and the issuance of which requires a certain amount of time. This documentation is reflected in the acquisition of water management acts, environmental permits, previous electricity approvals, urban approvals, as well as evidence of resolved property rights related to the property on which construction is planned.
