SARAJEVO, October 15 (FENA) – Institute for Research of Genocide Canada (IGC) has filed criminal charges against the president of the BiH entity Republika Srpska, Željka Cvijanović, for violating the law banning genocide denial, as well as for attempts to overthrow the constitutional and legal order of BiH and to violate the sovereignty, territorial integrity, political independence and international legal subjectivity of BiH.
As said in the IGC statement, Cvijanović issued a decree according to which the amendments to the BiH Criminal Code, passed by the former High Representative and criminally punishing the denial of genocide and other crimes convicted in domestic and international courts, are not valid in that entity.
“Amendments to the BiH Criminal Code are valid on the entire territory of BiH, and entity decrees cannot challenge the provisions of that law,” the IGC said, adding that Cvijanović's actions were contrary to the BiH Constitution and the Dayton Peace Agreement, and thus punishable under the Criminal Code.
Under international law, according to the IGC, the entity is not competent to enact such acts and, in this particular case, cannot produce any legal effect.
