Salkić: The Constitution of RS has been violated in Bratunac, Foča and Vlasenica

SARAJEVO, January 24 (FENA) - Vice President of the BiH entity of RS Ramiz Salkić issued a press release today regarding the formation of local authorities in the municipalities of Bratunac, Foča and Vlasenica, which allegedly violated the Constitution of the RS entity.

“The implementation of the results of the local elections held in 2020 has expanded discrimination against Bosniak returnees to the RS entity. Contrary to the precise constitutional provision to apply the 1991 census during the implementation of election results, they apply the provisions of the Law on Local Self-Government in some local communities, which conflict with the entity Constitution,” said Salkić in a statement.

He recalls that Article 97 of the RS Entity Constitution defines that "The constituent peoples and Others shall be proportionally represented in public institutions in the Republika Srpska. As a constitutional principle, such proportional representation shall be based on the 1991 census, while Annex 7 is not fully implemented, following the Law on Civil Service of Bosnia and Herzegovina. This general principle will be specified by entity laws. These laws will set specific deadlines and regulate the above-mentioned principle in accordance with the regional ethnic structure of the entities. Public institutions, as mentioned above, are ministries in the Government of the Republika Srpska, municipal authorities, district courts in the Republika Srpska, as well as municipal courts in the Republika Srpska.

However, he points out that the adoption of the Law on Local Self-Government in Article 4 of the Law defines the implementation according to the last census. Based on the results of the last census, local self-government units ensure proportional representation of constituent peoples and groups of Others in the bodies of local self-government units, including officials of local self-government units who are not directly elected: the president and vice-president of the assembly of the local self-government unit and the deputy mayor, i.e. the municipal mayor.

In the municipalities of Bratunac, Foča, Vlasenica and in some other municipalities in this entity, the application of the unconstitutional Article 4 of the Law on Local Self-Government resulted in the complete persecution of Bosniaks from the legislative and executive branches.

“Considering that this is a violation of the Entity Constitution, we call on and expect the reaction of the competent authorities to protect the Constitution and returnees in this area. Implementing systemic discrimination against returnees is a violation of the Dayton Peace Agreement and Annex VII of the Dayton Peace Agreement, and it is an invitation and obligation for the OHR and the High Representative to get involved in resolving this problem,” he added.

He expects in the coming period from those who have the opportunity to initiate an assessment of the compliance of Article 4 of the Law on Local Self-Government of the RS Entities with the Constitution of Bosnia and Herzegovina before the Constitutional Court of Bosnia and Herzegovina.
