Božidarka Dodik: Members of HJPC need to come from the courts themselves

SARAJEVO, December 15 (FENA) - A judge of the Supreme Court of the FBiH Božidarka Dodik was interviewed today at a session of the Ad Hoc Inquiry Commission of the House of Representatives of the BiH Parliamentary Assembly for determining the situation in the judicial institutions.

She assessed that the separation of the High Judicial and Prosecutorial Council (HJPC) of BiH from the professional community is evident and that this discrepancy is increasing.

As she explained, this calls into question the integrity of individual members of the HJPC BiH, as well as the HJPC itself, and therefore it is necessary for HJPC members to be representatives of the courts they come from and thus make the work of courts in BiH more efficient.

As one of the problems in the work of the judiciary, she pointed out the appointment of judges and managerial staff in judicial institutions. As she explained, the results of the appointment stem from the fact that individual judges and managers are not competent for the jobs to which they were appointed, and that is why we have public distrust in the work of judicial institutions.

In her testimony, Božidarka Dodik also emphasized the issue of the relationship between the media and judicial institutions and pointed out that the courts are not transparent enough in their work, but also that the media often act in a sensationalist manner, and not according to the principles of their media profession.

When it comes to problems in the work of courts and prosecutors' offices, she emphasized the issue of the mandate of court presidents and chief prosecutors. In her opinion, it is necessary to pass amendments to the law that would limit the mandate of court presidents and chief prosecutors.

As one of the problems, Dodik mentioned the issue of BiH's commitment as a state to fight corruption and organized crime. She said that, unfortunately, we currently have such a law that is not applied when it comes to the fight against corruption and organized crime.

She also addressed the issue of professional associations of judges and prosecutors, the establishment of departments for the fight against organized crime and corruption, the issue of conflict of interest of members of the HJPC, as well as the issue of their breach of duty.

After the examination of witnesses, the members of the Inquiry Commission expressed, among other things, interest in which laws need to be changed in order to make the judiciary in BiH more efficient and restore its integrity, how it would be possible to regulate the expertise of judicial staff and the quality of work of judges at lower levels.

At today's session, the Inquiry Commission adopted a conclusion asking the competent services of the PA BiH to post audio recordings of all sessions of the  Inquiry Commission on the website of the Commission and to continue posting audio recordings of all future sessions.
