Constitutional Committee: SDP's amendments not in line with BiH Constitution

SARAJEVO, December 7 (FENA) - Members of the Constitutional and Legal Committee of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina assessed today that the amendments proposed by Social Democratic Party (SDP) deputies to the BiH Constitution are not in accordance with the BiH Constitution and legal system. These are amendments also known as the “April package”.

The amendments envisage strengthening the capacity of the state parliament, and the number of deputies in the House of Representatives would increase from the current 42 to 87 deputies.

There would be 21 delegates in the House of Peoples instead of 15 that we have now. These amendments envisage the introduction of the President of Bosnia and Herzegovina as well as the function of the Prime Minister of the state.

After such a vote for the amendments, the Committee gave a negative opinion on that proposal, and the deputies of the House of Representatives of the Parliamentary Assembly of BiH will vote on this negative opinion of the Committee on Wednesday when the session of the House is scheduled.

The parliamentary initiative of Edita Đapo (Alliance for a Better Future - SBB) was supported, which calls for an amendment to the Citizenship Act in order not to require renunciation of citizenship of countries that have changed their legislation and allow multiple citizenships (Denmark, Norway, Luxembourg, Czech Republic and others) and to urgently conclude a bilateral agreement with those countries.

The committee did not support the parliamentary initiative submitted by the deputies of the Croat Democratic Union (HDZ) caucus, which requested that August 23 be marked as the European Day of Remembrance of the Victims of Totalitarian and Authoritarian Regimes.

On behalf of the proponent, Nikola Lovrinović (HDZ) explained the initiative and proposed conclusions that would pay tribute to the victims of totalitarian regimes and encourage the BiH authorities to enable and help identify places of suffering, mark those places and determine the names of victims.

Also, the conclusions asked the Council of Ministers of BiH to pass legislation within a year, which prohibits events, groups and associations glorifying totalitarian ideologies, and to prohibit the use of symbols of totalitarian regimes (Nazism, fascism and communism) in public and commercial purposes.

The Committee adopted the parliamentary initiative of the MP of the Party of Democratic Action (SDA) Denis Zvizdić, which instructs the Council of Ministers of BiH to propose a new Law on Medicines and Medical Devices of Bosnia and Herzegovina within 30 days, in order to harmonize the law with the new regulation of the European Union.

Also, Zvizdić proposed that this law regulate this area in terms of international trade and procurement of medicines and medical devices and harmonize it given the existing situation caused by the coronavirus pandemic (Covid-19).

The Committee also adopted Zvizdić's initiative asking the BiH Council of Ministers to propose a Framework Law on Environmental Protection, Development and Use of Natural Resources of Bosnia and Herzegovina, which would not violate the constitutional competence of any level of government.

During the explanation of the initiative, Zvizdić warned that BiH would not be able to participate in the "Green Agenda" program without such a law, which the European Union wants to support with significant financial resources.
