SARAJEVO, February 12 (FENA) – Party of Democratic Action (SDA) believes the announcement by political representatives from the RS entity that they will not participate in state institutions is "a classic form of political bullying".
The Constitutional Court of Bosnia and Herzegovina is a Dayton category, as is the very existence of the entities, and any unilateral challenge to the Constitutional Court is in fact a unilateral violation of the Dayton Peace Agreement and an attack on the constitutional order of Bosnia and Herzegovina, it is said in a statement of the SDA.
The SDA calls on the institutions of the international community, as well as all patriotic forces in BiH, to "oppose such unilateral steps by RS entities that threaten political and overall social stability in BiH."
Any reform of the Constitutional Court means reform of Dayton and it is possible only if all parties in Bosnia and Herzegovina reach consensus, with the consent of the international community. Every other attempt to change Dayton, and especially one based on ultimatums and blackmail, is doomed to failure.
Neither the SDA nor the Bosniaks appoint foreign judges, but in accordance with Article 6 of Annex IV of the Dayton Agreement, the President of the European Court of Human Rights in Strasbourg does so. Obviously, the problem of parties from the RS entity with foreign judges is actually a problem with the European principles and practice of the European Court of Human Rights, which these judges are implementing, SDA stated.
The SDA also believes that requests from the RS entity to withdraw foreign judges from the BiH Constitutional Court before ending the mandate of the OHR and PIC and implementation of the Dayton Peace Agreement are "absolutely unfounded, and there is no way they will be approved".
