Indictment confirmed in Simo Stupar et al. case for war crimes against humanity

SARAJEVO, November 15 (FENA) - On 1 November 2018, the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Simo Stupar, Zoran Stupar, Zoran Tešić and Goran Tešić with the criminal offense of Crimes against Humanity under Article 172(1)h), as read with Subparagraphs a), e) and k) of the Criminal Code of Bosnia and Herzegovina (CC BiH), in conjunction with Article 29 and Article 180(1) of the CC BiH.

The indictment alleges that between April 1992 and late September 1992, in the municipality of Vlasenica, in the framework of a widespread and systematic attack by members of the TO of the Serb Municipality of Vlasenica, subsequently members of the Army of the Serb Republic of Bosnia and Herzegovina and the police of Public Security Stations of the Serb Municipality of Vlasenica, supported by para-military formations coming from Serbia, aimed against the non-Serb civilian population in the territory of Vlasenica municipality, the accused Simo Stupar, Zoran Stupar and Goran Tešić, as members of the reserve unit of the Vlasenica Public Security Station, and the accused Zoran Tešić as a member of the Army of Republika Srpska, VP 7296 Milići, knowing of the attack and that their actions constituted a part thereof, participated in the persecution of the Bosniak civilian population on ethnic and religious grounds in relation to the killing and other serious deprivation of physical liberty in violation of the fundamental rules of international law, other acts of inhumane treatment of a similar nature, committed with the intent of inflicting great suffering or serious physical or mental injury or deterioration of health and arbitrary and militarily unjustifiable destruction and appropriation of property on a large scale, stated the BiH Court.
