BiH Prosecutor's Office files an indictment against 10 persons in 'Dobrovoljačka street' case

SARAJEVO, April 27 (FENA) - The Prosecutor's Office of Bosnia and Herzegovina has issued an indictment against ten persons concerning the wartime events of May 1992 in the then Dobrovoljačka Street in Sarajevo.

The accused are Ejup Ganić (1946), Zaim Backović (1954), Hamid Bahto (1961), Hasan Efendić (1934), Fikret Muslimović (1948), Jusuf Pušina (1949), Bakir Alispahić (1956), Enes Bezdrob (1961), Ismet Dahić (1954) and Mahir Žiško (1971), the Prosecutor's Office of BiH announced.

The investigation resumed due to suspicion of a committed war crime, and the decision repealed an earlier order to suspend the investigation from January 17, 2012, in relation to five persons.

Bosniaks and Serbs have conflicting narratives about the clash on May 3, 1992, when Bosnian forces attacked a  Yugoslav People's Army (JNA) convoy that was leaving the city per a withdrawal agreement but took the president of Bosnia and Herzegovina with them as a hostage.

The JNA captured the first President of the Republic of Bosnia and Herzegovina, Alija Izetbegović, at the Sarajevo International Airport the previous day as he was returning from negotiations in Lisbon and it was agreed the President would be freed in return for the uninterrupted withdrawal of the JNA soldiers from the barracks in Sarajevo.

Allegedly, Bosnian forces stopped the convoy in Dobrovoljačka street, in downtown Sarajevo, to free their president and despite the order to cease fire, issued by General of the then Army of the Republic of Bosnia and Herzegovina, Jovan Divjak, the clash occurred which led to the death of former JNA soldiers.

Bosnian Serb representatives claim that 42 innocent young men, members of the former JNA, were killed while 70 were injured and 200 detained.

The BiH prosecutors say eight persons were killed, 24 wounded, and several dozens were detained, then tortured and abused. 

The Prosecutor's Office of BiH, together with the State Investigation and Protection Agency (SIPA) and the RS Ministry of the Interior, conducted a thorough investigation in which hundreds of witnesses were examined, including surviving soldiers and civilians, families of killed and wounded victims, as well as a large number of event participants.

Along with the indictment, the examination of 277 witnesses was proposed, as well as several experts, and more than 500 pieces of material evidence were attached to support the allegations in the indictment, the statement said.
