Dragnić appealed to BiH Constitutional Court on grounds of discrimination

SARAJEVO, April 23 (FENA) - Our Party's (Naša stranka) Ethics Committee Chairwoman Lejla Dragnić was one of the two appellants who filed an appeal with the Constitutional Court of Bosnia and Herzegovina, which found that human rights have been violated with the Order on ban on movement of persons over the age of 65 and under the age of 18 during the coronavirus pandemic. 

Dragnić said that one of the reasons to appeal was the feeling of discrimination, but also the fact that BiH is one of the few countries that opted for such a measure.

"Since the beginning of the crisis, I have behaved in accordance with all the recommendations: physical distancing, personal protection, but I have kept the habit I have had for years, which is walking six to eight kilometers a day. These walks are extremely important for my health as well as for the health of all the people in my age group. In doing so, it was clear that many people who were not prohibited from going outdoors have not adhered to all of the recommendations of the Crisis Staff recommendations without suffering any consequences for it," she said.

Dragnić emphasized that she was satisfied with the Decision in the part of the conclusion that human rights of persons over 65 and under the age of 18 have been violated, and that there was no proportionality between this measure and the public interest.

"I did not expect the order to be abolished, but I hope that the Crisis Staff will find a more humane way of preventing the spread of the virus among the older population as well as among the young, in compliance with the Constitutional Court's decision," she added.

She believes that the authorities in extraordinary circumstances must have confidence in citizens and their responsibility towards their own health, but, because of possible misuse by individuals, the authorities cannot disregard human rights of the entire population.
