MOSTAR, September 27 (FENA) - Representatives of the citizens' association "For Doljanka River" from Jablanica, who have been fighting against the hydropower plant "Zlate" for many years, pointed out once again at a press conference in Mostar the problems they face in fighting for their rights.
The court annuls the environmental permit, but the HPP is still working
The citizens' association initiated two administrative disputes, one against the construction permit before the Municipal Court in Mostar, and the other against the environmental permit before the Cantonal Court in Sarajevo.
Two years and ten months after the administrative dispute was initiated, a month ago, the association received a decision from the Sarajevo Cantonal Court revoking the environmental permit for the Zlate hydropower plant on the Doljanka River issued by the FBiH Ministry of Environment and Tourism based on which the FERK in 2020 issued a license for the company Eko-Vat. The court revoked the environmental permit and returned the proceedings to the beginning.
"We point out that this verdict annulled the environmental permit as if it never existed. What we want to emphasize is that in the reasoning of the verdict, the court pointed out exactly those violations that we pointed out to FERK and other institutions all the time during the period of obtaining the necessary permits, i.e. before issuing of the operating permit," said Naza Spahić, vice president of the association.
They emphasize that the avoidance of setting deadlines in both cases indicates a renewed favoring of the investor who can prolong this procedure indefinitely without suspending its work, or continuing to work without valid documentation. Although the environmental permit has been revoked, the investor continues to operate without the key document on the basis of which the operating permit was issued.
"As time goes by we are increasingly aware of the magnitude of the problem we have tackled but we will not give up in our further struggle. And as we have pointed out so far, every time we address the public and talk to institutions, we are ready to go all the way. We are ready to initiate all legal remedies in BiH and before international courts. Especially now that the legal battle in the form of court rulings has confirmed our doubts and that our claims have been substantiated," said Dženan Šašić, president of the association for the protection of the Doljanka River.
