Krišto: Amendments to Election Law must be imperative for everyone

SARAJEVO, March 7 (FENA) - Speaker of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina Borjana Krišto (HDZ BiH) points out that we are witnessing many parliamentary initiatives based on populism to collect daily political points in the highest legislative body in the country.

In an interview with FENA, she assessed that this is what prevents constructive debates and the functioning of the parliament, as well as the performance of the basic legislative task.

When it comes to the relation between the members of the Collegium of the House, in which, in addition to Krišto, there are also Nebojša Radmanović (SNSD) and Denis Zvizdić (SDA), she notes that they work within their competencies defined by the Rules of Procedure and the Constitution.

Asked whether there is a stable parliamentary majority in that House, Krišto said that unlike the Collegium, where decisions are made by consensus, the majority in the House of Representatives differs from session to session or from item to item on the agenda.

“Unfortunately, part of the parliamentary majority that formed the Council of Ministers of BiH is often something that prevails on the scale and gives space to populist initiatives, and then they themselves fall for that populism,” Krišto thinks.

If we add to that the adoption of certain decisions that have no legal basis, says Krišto, such as the appointment of members of the Central Election Commission, but also other decisions, such a way of functioning directly harms Bosnia and Herzegovina as a democratic state established on the principles of three constituent people and others who live in it.

Krišto also referred to the obligations of the Parliamentary Assembly of BiH in terms of fulfilling the 14 priorities set before BiH by the European Commission for obtaining candidate status, saying that everything related to legislation is the responsibility of the Parliamentary Assembly.

She also participated in the meeting of HDZ and SDA delegations when it was agreed to form three working groups that should resolve open issues within BiH, regarding changes to the Election Law, resolving issues at the level of the Federation of BiH and meeting BiH conditions on its path to the European Union.

BiH PA HoR Speaker confirmed that she will be one of the members of the working group that will negotiate changes to the Election Law, which will also include Bariša Čolak, Josip Merdžo and HDZ BiH president Dragan Čović. She explains that the agreement stipulates deadlines within which agreed solutions on legitimate representation in the Presidency of BiH and the House of Peoples should be offered, as well as the implementation of the decisions of the European Court of Human Rights.

“In a certain phase, the political representatives of all three constituent peoples must be included, because that is required by the Constitution of BiH, but also to ensure the adoption of the law in the parliamentary procedure,” she explained.

When asked what exactly is expected from the changes to the Election Law, Krišto says that there is no alternative because changes to the Election Law must be imperative for everyone to step into the election process with clear rules before 2022, when the general elections in BiH will be held.

Therefore, she emphasizes that this refers to the amendments to the Election Law which fully implement the decisions of the Constitutional Court of BiH on the legitimate representation of constituent peoples, as well as the decisions of the European Court of Human Rights, which are a necessity and priority, but also the most current problem.

This primarily refers to the implementation of the recommendations of GRECO (Group of States against Corruption of the Council of Europe), ODIHR (Office for Democratic Institutions and Human Rights of the OSCE) and the Venice Commission on the protection and improvement of the quality of integrity and transparency of the electoral process.
