An agreement for easier realization of consumer rights signed with BiH Ombudsman

SARAJEVO, December 8 (FENA) - The agreement on cooperation between the Institution of the Ombudsman for Consumer Protection of BiH and the Association for Consumer Protection, which was signed today in Sarajevo, will enable easier access to justice for consumers and easier realization of consumer rights.

It is an agreement on cooperation between the Ombudsman Institution and 15 consumer protection associations from BiH, which defines protocols for various forms of institutional support to consumer associations and enables the exchange of information, knowledge and good practices, with the aim of improving consumer protection.

"The agreement contributes to more dynamic cooperation between the governmental and non-governmental sector in this area, which ultimately means easier access to justice for consumers, ie. easier access to the exercise of consumer rights, more uniform legal practice and the equal position of all consumers in BiH," said Saša Marić, the Ombudsman for Consumer Protection of BiH.

Marić pointed out that they are focused on achieving three results - improving consumer awareness of their rights, better cooperation between civil society organizations and the Institution in finding collective recommendations and finding modalities to help legislatures so that the Consumer Protection Act can be improved and to incorporate the eight latest EU directives.

"The law on consumer protection at the state level is already 11 years old and requires some improvement, especially in terms of EU directives. It can be better implemented in the field where closer cooperation of the Institution, civil society organizations and competent inspections is needed," stated Marić.

According to him, the Ombudsman Institution will round up this year with more than a thousand complaints, which has been a trend in recent years, and the goal is to raise consumer awareness of their rights so that this number can increase. The more consumers are aware of their rights, the market can be better regulated.

In order to protect the collective interests of consumers, the Ombudsman has the opportunity to initiate a collective lawsuit, which, in the opinion of the consumer protection association, is one of the benefits of the agreement. 

"Irregularities that we as associations notice in practice are very slowly resolved by amendments to the law. However, by initiating the collective interests of consumer protection, a better business practice will be created, which has the ultimate goal of protecting all consumers," stated Dušan Srdić from the Consumers' Association "Reakcija".
