Ex-RS Army commander Zoran Malinić charged with aiding and abetting genocide

SARAJEVO, October 9 (FENA) - The prosecutor of the Special Department for War Crimes has filed an indictment against Zoran Malinić (1961), born in Sarajevo, residing in Belgrade, a citizen of the Republic of Serbia.

Malinić is charged with knowingly assisting and participating in a joint criminal enterprise with the intent to commit and execute genocide during a widespread and systematic attack by the RS Army and the police, on the Bosniak civilian population in the "UN Protected Area" in Srebrenica in July 1995, during which a group of Bosniaks was partially exterminated, the entire Bosniak civilian population was removed from the Srebrenica enclave, and the men and boys killed. Malinić acted in the capacity of the commander of the Military Police Battalion of the 65th Protective Motorized Regiment of the RS Army. 

The indictment alleges that Malinić planned, supervised and coordinated the activities of members of the Military Police in the area of ​​Nova Kasaba and its surroundings, who, after the fall of Srebrenica, ambushed, intercepted, captured and killed Bosniak civilians.

The indictment alleges that members of the Military Police, on the orders and with the approval of the accused, killed a group of 12 captured civilians, including women and the wounded.

The indictment also relates to the capture and abuse of a group of at least 20 prisoners at a school in Nova Kasaba, as well as the capture of hundreds of civilians held in inhumane conditions at a stadium in Nova Kasaba, who were then transported to Kravica and Bratunac in the evening of the same day, held in detention facilities, and subsequently shot and killed at various locations where victims of the Srebrenica genocide were executed.

Malinić is charged with aiding and abetting genocide under the Criminal Procedure Code of BiH. 

The Prosecution of Bosnia and Herzegovina intends to prove the allegations of the indictment by calling 130 witnesses, enclosing the statements of six witnesses who have died in the meantime, enclosing 285 pieces of material evidence, including evidence obtained from the ICTY Prosecution, as well as the statements of 28 witnesses who gave their testimonies before the ICTY, in addition to the testimonies of two forensic medicine and military professionals, the Prosecutor's Office of BiH announced.
