SDA: Entities have no right to self-determination under the Dayton PA

FENA Press release

SARAJEVO, September 18 (FENA) - The Party of Democratic Action (SDA) believes the SNSD main board’s conclusions which announce "the activation of the right to self-determination", are a gross undermining of peace and stability in BiH, and a direct attack on the Dayton Peace Agreement, which does not contain a single word that allows the possibility of self-determination to entities or individual ethnicities in BiH.

“The entity of RS exists solely by virtue of the Dayton Peace Agreement, and does not possess any rights except those listed in the Dayton Agreement. All the rest are desperate illusions of Milorad Dodik and the SNSD, which represent a dangerous trajectory and a first-class security threat,” the SDA said in a statement.

By inventing the right to self-determination of the entity of RS, through frivolous and outright wrong interpretations of UN conventions, whose sole signatories are states, not regions or entities, with announcements of unilateral activation of this so-called "right" - represents a dangerous abandonment of the Dayton PA framework, as the most important legal act which defines the current status of BiH in the international law system, and thus stability and peace in Bosnia and Herzegovina and this part of Europe.

The SDA points out that the Dayton Peace Agreement can only be modified by consensus, "and as long as the SDA has a say in the process, the only possible changes are harmonization with the European Convention on Human Rights and implementation of the European Commission's Opinion, with the aim of strengthening the civic principle and supremacy of the state over the entities."

“Dodik's dangerous anti-Dayton, anti-consensual and secessionist messages require urgent and decisive reaction from the Peace Implementation Council and the OHR, and Dodik himself and the SNSD must understand that by unilaterally abandoning the Dayton Peace Agreement, they directly  endanger peace, but also they would be invalidating the only act under which the entities in BiH exist, and they would, therefore, bring themselves into a political and strategic impasse from which it will be difficult to find a way out,” underlined the SDA.
