Institutions in BiH continue with violations of the Public Procurement Law

SARAJEVO, May 20 (FENA) - The Law on Public Procurement of Bosnia and Herzegovina is being violated at all stages of the process, and it is violated by all institutions, from municipalities to the BiH Presidency, as it is shown in the monitoring of public procurements carried out by non-governmental organizations using examples of 1,338 procurement procedures worth 400,000,000 KM.

This is the third year since the teams of the Open Society Fund of BiH, Development Agency Eda Banja Luka, Transparency International BiH, the Center for Investigative Reporting of BiH and the association of citizens "Tender" Banja Luka are doing the monitoring of the procurement process.

In these three years, they analyzed 9,146 individual public procurement procedures for all sorts of goods, works and services at all administrative levels in BiH covering the amount of more than 3.2 billion KM.

As representatives of these organizations pointed out during the presentation of the report at today's press conference in Sarajevo, despite the large number of complaints filed with the Public Procurement Agency, the adequate response of the competent institutions and the judiciary is still lacking.

Because of all this, the bidders do not have confidence in the public procurement process, said Mervan Miraščija from the Open Society Fund of BiH today, but he especially warned of the fact that large sums of money from public funds are being lost, between 450 and 600 million KM through this type of spending.

“We in BiH are still dealing with non-transparent and discriminatory public procurement procedures that almost completely destroys active competition and are inefficient, uneconomic and unscrupulous,” added Miraščija.

Improvements in the process of the public procurement plan in some of the contracting authorities are visible, but this is the case with mainly the institutions with small public procurement budgets. Also, there is some progress in the bodies under the control of the executive power and those overseen by international financial institutions.

Aleksandra Martinović from the Transparency International BiH said that 1,000 filings were submitted to various institutions, including 14 lawsuits, for which seven judgments were passed in favor of TI BiH, 77 reports to the Public Procurement Agency and two positive recommendations of the BiH Ombudsman were also handed down.

She added that there was one hundred percent increase in the number of public procurements on the official web portal in the 2018 election year compared to 2017, and this year as well, the number of calls has also recorded slight growth.

A survey conducted last year showed that 88 percent of respondents among 53 BiH-based companies believe that certain institutions favors certain bidders in the process of public procurement, EDA's Aleksandar Draganić said, adding that the same number of respondents think corruption is present in public procurement processes.

As an example of violations of the principles of public procurement, they singled out the cases of procurement of tractors, passenger motor vehicles, and the monitoring team also observed the trends in the procurement and maintenance of IT equipment.

In this segment, there are too many inadequate requirements for licensed professionals of different profiles or too high technical and professional requirements, which often results in only one offer being submitted, whose value is almost always just below the estimated value indicated in the tender documentation.
