EAST SARAJEVO, January 23 (FENA) - An initiative that calls for the re-examination of the constitutionality of the name of the BiH entity of Republika Srpska is nothing new, but Republika Srpska is a constitutional category and as such is internationally recognized, said today at a press conference held in East Sarajevo the BiH Presidency Chairman and leader of the Alliance of Independent Social Democrats (SNSD) Milorad Dodik.
The Party of Democratic Action (SDA) today announced that it will initiate legal proceedings before the Constitutional Court of Bosnia and Herzegovina, through its representatives in the state institutions, for the purpose of reconsidering the constitutionality of the name of the entity of Republika Srpska.
Dodik reminded that former SDA President Sulejman Tihić in the past launched the same initiative and withdrew it because, as Dodik said, international pressure, and referred to this new announcement from SDA as “the continuity of the Bosniak attempts to make the entity of Republika Srpska the main problem”.
He points out that RS is visible in all parts of the BiH Constitution, and therefore considers that there is no basis for this initiative before the Constitutional Court of BiH, but if that happens, he said that his participation in the BiH Presidency would be jeopardized.
“Submitting such an initiative before the Constitutional Court would momentarily trigger a session of the entity parliament and all negotiations on forming the state government would be terminated. This would be a point of no return for me, as it means the relegation of the constitutional order. This is a way to push RS further away from BiH, and I ask them, please continue doing this,” Dodik said.
The SDA today stated that according to the BiH Constitution, all three constituent peoples are equal in the entire territory of the country, including both of the entities and the Brčko District of Bosnia and Herzegovina, as it is has been confirmed by the Constitutional Court’s decision on the constitutionality of the people U5/98, ordering the entities, in their constitutional systems to ensure full equality for all constituent peoples.
The BiH entity of Republika Srpska exists under the BiH Constitution as a multi-ethnic entity, in which all peoples must have equal rights, which means that one nation alone cannot be represented in its name, while the others are excluded, stressed the SDA.
Therefore, the Party of Democratic Action announced that it would initiate a procedure to harmonize the name of the entity of Republika Srpska with the Constitution of Bosnia and Herzegovina, on the basis of existing decisions of the Constitutional Court of BiH on the constituent status and equality of all peoples in BiH.
