Miro and Ante Kvesić sentenced to 1 year in prison each with suspended sentence

SARAJEVO, May 15 (FENA) - The Panel of Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina, upon examination of a plea agreement and sentencing hearing, delivered a judgment on 14 May 2018, finding the Accused Miro Kvesić guilty of the criminal offense of Organized Crime in violation of Article 250(2) as read with the criminal offense of Illicit Trade in Excise Products in violation of Article 210a. of the CC of BiH, and the Accused Ante Kvesić criminal offense of Illicit Trade in Excise Products in violation of Article 210a. of the CC of BiH, as read with Articles 31 and 54 of the CC of BIH.

The Court imposed on the Accused Miro Kvesić a sentence of one-year imprisonment and an accessory sentence - the fine in the amount of 20,000.00 BAM which the Accused has to pay within six months from the day the Verdict becomes final and binding. If the Accused fails to pay the fine in the said deadline the Court shall, without delay, in accordance with Article 47(3) of the CC of BIH, replace the fine with prison sentence so that every 100 BAM of fine shall turn into one day of prison, without exceeding the prescribed fine for the offense.

The Court imposed on the Accused Miro Kvesić a security measure - seizure of items, and also seized the ill-gotten gain in the amount of BAM 14.802,00 which has to be paid in the budget of BIH within 30 days from the day the Verdict becomes final and binding.

The Court imposed on the Accused Ante Kvesić a suspended sentence of 1 year in prison which shall not be executed unless the Accused commits another criminal offense within two years from the date the Verdict becomes final and binding.

Pursuant to Article 188 (1) of the Criminal Procedure Code of BIH, the Accused Miro Kvesić and Ante Kvesić are ordered to pay the costs of the criminal procedure in the amount of BAM 100.00 for the lump-sum within 15 days from the day the Verdict becomes final and binding.
