Indictment confirmed in Tomislav Kovač case for crime of genocide

SARAJEVO, January 30 (FENA) - On 18 January 2018, the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Tomislav Kovač with the criminal offense of Genocide under Article 171, Subparagraphs a) and b), of the Criminal Code of Bosnia and Herzegovina, as read with Article 180(1) and Article 29 of the same Code.

The Indictment charges the accused Tomislav Kovač that between 6 July, and 1 November 1995, during a widespread and systematic attack against the Bosniak civilian population of the UN Safe Area of Srebrenica and Žepa, within which the VRS and MUP RS forces carried out the operation of a lasting and forcible transfer of the entire Bosniak civilian population from the UN Safe Area of Srebrenica and Žepa, the operation of capturing, detaining and summarily executing able-bodied Bosniak men and boys from the Srebrenica enclave, and the operation of concealing evidence of execution by exhuming bodily remains of the victims from primary mass graves and reburying them in unmarked secondary mass graves, as MUP RS Police Staff Commander and Deputy Minister and Minister of MUP RS, with all the authority vested in MUP Minister, acting individually and in collusion with other participants in the joint criminal enterprise, who had the intention and common purpose to partly exterminate a group of Bosniak people of the Srebrenica enclave by way of forcible transfer of some 40 000 women, children and elderly, and by summary execution of some 8 000 Bosniak men and boys, aware of the fact that his conduct and actions were taking place in the context of a widespread and systematic attack aimed at the forcible transfer of the Bosniak civilian population and mass liquidation of Bosniak men, which would result in the partial destruction of a group of Bosniak population of the UN Safe Area of Srebrenica, he carried out activities in terms of planning, preparing, supporting, aiding and abetting and perpetrating the criminal offenses described in more detail in the Indictment, whereby he gave significant contribution to achieving the common purpose.

The Indictment was not returned for consolidation to the Prosecutor's Office of Bosnia and Herzegovina. The indictment will be served on Tomislav Kovač via Mutual Legal Assistance mechanism, given that the accused is currently residing in Serbia, stated the BiH Court.
