Publication presented on the importance of judicial practice in the fight against organized crime

SARAJEVO, March 20 (FENA) - Today in Sarajevo, representatives of the Constitutional Court of BiH and the AIRE Center, with the support of the Government of the United Kingdom, presented the publication "Analysis of the practice of the highest courts in BiH in cases of organized crime and corruption", which offers an overview of a significant number of judgments of regular courts related to organized crime.

"One of the important conclusions of this analysis is that the judicial system in BiH at the level of the highest courts, as well as the courts of the first instance, has a respectable professional capacity to deal with the most difficult challenges that are put before it in the trial process," said the Vice President of the Constitutional Court of BiH Zlatko Knežević.

The analysis also indicates that corrupt criminal offenses are processed relatively quickly and that there are no major problems in proving them. However, as the Analysis showed, the issue of abuse of influence and position continues to be a problem both in the indictment and in the adjudication.

At the presentation of the publication, the representatives of the AIRE Center thanked the expert team of the Constitutional Court of BiH, which was engaged in the preparation of this Analysis.

Biljana Braithwaite, Director of the Program for the Western Balkans of the AIRE Center, pointed out that one of the goals of the Analysis is to present to the judicial community how and how successfully the courts in BiH resolve cases related to organized crime and corruption, valuing all important aspects of a trial.

"The analysis provides an insight into the way the courts solved complex issues in all stages of the trial with reference to the speed of processing, the evidence that was produced, the way in which expert opinions were conducted from different fields, and the evidence collected by modern technological means of communication," added Braithwaite.

As it was said, the Analysis should be the basis for further intensive work and expert discussion based on the presented conclusions, for which the AIRE Center is ready to provide the necessary support.

On this occasion, British Ambassador to BiH Julian Reilly said that the United Kingdom is proud to work with the Constitutional Court of BiH and the AIRE Center in developing analysis in cases of organized crime and corruption.

"We are especially proud because prominent legal experts and judges, who are directly involved in the work on cases of corruption and organized crime, worked on this Analysis. We look forward to achieving results thanks to this Analysis, which highlights a number of important issues," said Reilly.
