RS Constitutional Court rejects the request of Bosniak caucus in the Council of Peoples

BANJA LUKA, February 9 (FENA) - The Council for the Protection of Vital Interests of the Constitutional Court of the Republika Srpska decided today on the request of the Bosniak People’s Caucus in the RS Council of the People to determine the violation of the vital national interest of the Bosniak people in the Law on Immovable Property, which uses for the functioning of public authorities, which the National Assembly of the RS voted on December 28, 2022 and rejected the request.

“Therefore, the Council discussed the aforementioned request, i.e. whether there are procedural legal conditions whether the disputed law violated the vital national interest of the constituent Bosniak people,” the Constitutional Court of the RS announced.

It is stated that the applicant in its request pointed out, in essence, that the aforementioned law is directed against the state of Bosnia and Herzegovina and its institutions, that it negates the Constitution of BiH and the division of competencies between the state and the entities, and that it is thus violated the vital national interest of the Bosniak people because the Bosniak people tie their identity to the state of BiH, which is attacked by this law.

“Resolving the question of the admissibility of the request, the Council determined that such a request is not admissible considering that, as in several cases so far, the explanation of the Decision on initiating the procedure for the protection of the vital national interest cannot be considered as an explanation in the sense of the provision of Article 48, paragraph 1, indent 2 of the Rules of Procedure of the Constitutional Court of the RS.

Namely, the Council assessed that the applicant did not specify in what way the vital national interest of the Bosniak people was violated because the explanation of the Decision does not contain reasons that can be linked to the relevant provisions of the Constitution of the RS on the protection of the vital national interests of the constituent peoples determined by Amendments LXXVII on Article 70 of the Constitution of the RS, it is stated in the announcement.
