BiH CEC initiates adoption of amendments to the BiH Election Law

SARAJEVO, July 9 (FENA) - At today's 34th session, the Central Election Commission (CEC) of BiH adopted the Conclusion on initiating adoption of the law on amendments to the BiH Election Law, the CEC announced.

The Central Election Commission of BiH, in accordance with its powers, initiates a legal solution that would ensure the financial independence of the Central Election Commission of BiH so that it would no longer happen that after more than two months from the day of calling the elections, financial resources for elections are not provided.

To comply with European democratic standards, procedural guarantees must be met for elections, one of which concerns independent and impartial election administration bodies, as stated in the Venice Commission Code of Good Administrative Behavior under point 85 on page 27 (CDL-AD (2002) 023 rev) that "the election law should contain a provision requiring the authorities (at all levels) to meet the requirements and needs of election commissions."

Bearing in mind that organization and conduct of elections must be entrusted to an independent body, to which funds for conducting elections will be provided within the legal deadlines, the Central Election Commission of BiH initiates amendments to the Election Law of BiH in accordance with which funds for conducting elections would be provided within the statutory deadlines, and which at the same time offer an alternative way to overcome the problem of securing funds if for some reason they are not provided within the legal deadline.

This alternative would imply the obligation of the Council of Ministers of Bosnia and Herzegovina, in case of non-compliance with the current legal solution, at the request of the Central Election Commission of Bosnia and Herzegovina, within eight days to make a special decision to provide funds for elections.
