Bratić: Amendments to RS Law on Forests to be harmonized with BiH Constitution

BANJA LUKA, June 29 (FENA) - The proposed amendments to the Law on Forests of RS are disputable for the parliamentary group "Together for BiH" because they violate the Constitution of BiH.

MP Senad Bratić (SDA) believes that RS is trying to become titular of state property with this law, which is contrary to the Constitution of BiH, whose provisions determine the legal continuity of the state of BiH in that area.

“BiH has the exclusive right to continue to regulate state property of which it is the holder,” said Bratić during today's discussion on amendments to the Law on Forests at the session of the National Assembly of RS.

He reminded that in 2012, the Constitutional Court of BiH, deciding on the appeal of the then member of the Presidency of BiH Sulejman Tihić, assessed that the Law on the Status of State Property Situated on the Territory of RS is disputable, because it is the exclusive competence of BiH to regulate the issue of this property, therefore the law cannot remain in force.

On behalf of the "Together for BiH" parliamentary group, Bratić proposed several amendments to bring the amendments to the RS Forest Law in line with the BiH Constitution.

In case their proposal is ignored, this parliamentary group will not support the planned amendments, and it will initiate mechanisms in order to bring the given solutions in line with the Constitutional BiH.

He called on the competent legislative committee to take into account not only the laws of RS, but also those at the level of BiH.

“We want the National Assembly to adhere to its competencies,” said Bratić.

The proposed amendments to the Law on Forests are aimed at more precisely defining the assets of a public company, the manner of keeping forest wood assortments confiscated during inspections and expanding possible business and organizational forms of contractors in forestry.
