PACE Committee: ECHR judgments in BiH have not been implemented for 10 years

SARAJEVO, June 5 (FENA) - Member of the Delegation of the Parliamentary Assembly of Bosnia and Herzegovina (BiHPA) to the Parliamentary Assembly of the Council of Europe (PACE) Alma Čolo participated today in a video session of the PACE Committee on Legal Affairs and Human Rights.  

At the beginning of the session, the members of the Committee were addressed by the President of the PACE, Rik Daems, who said that the committees are already preparing their reports regarding the COVID-19 pandemic, which will be discussed at the first plenary session of PACE.

The members of the Committee discussed the draft report on the implementation of the judgments of the European Court of Human Rights, after which they adopted a motion for a resolution and a motion for a recommendation.

Rapporteur, Constantinos Efstathiou from Cyprus, stated in his report that there is still a significant number of countries that have not implemented the judgments of the European Court of Human Rights, and some countries have not implemented one or more judgments of the Court for more than ten years.

The rapporteur emphasized that parliaments have a significant role in implementing the Court's judgments, as many judgments require significant reforms in states, often constitutional changes.

The Committee's rapporteur stated that the example of Bosnia and Herzegovina, as well as some other countries, is a classic example of political obstruction due to which verdicts are not implemented, which, as he said, prevents the state from moving forward.

Čolo presented to the members of the Committee her review of the fact that BiH has not yet implemented the judgments of the Court, especially in the cases Sejdić and Finci, and Baralija v. Bosnia and Herzegovina, warning that the complex structure of the state makes it difficult to implement these judgements.

Also, Čolo emphasized that she is aware of the fact that parliamentarians have a particularly important role in the implementation of the Court's judgments.

Regarding the impact of the pandemic on human rights and the rule of law, Committee Chairman Boriss Cilevics said that the Committee had recently organized two webinars with the participation of prominent figures, including Council of Europe Commissioner for Human Rights Dunja Mijatović where they discussed the response of states to the COVID-19 pandemic.

At the end of the meeting, the members accepted the plan to hold the sessions of the Committee by the end of this year, the BiHPA announced.
