DF: BiH Constitutional Court should issue temporary rules for Mostar elections

SARAJEVO, May 8 (FENA) - Democratic Front (DF) calls on the Constitutional Court of Bosnia and Herzegovina to adopt temporary rules for holding elections for the City Council of the City of Mostar.

DF reminds that the Central Election Commission of BiH passed the Decision on calling and holding local elections in BiH in 2020, on Sunday, October 4, and again without calling elections for the City Council of the City of Mostar.

“Despite all proposals for finding a political solution to amend the Election Law regarding the elections for the Mostar City Council, including the proposal submitted to the parliamentary procedures by the Democratic Front, the lack of political will to find a solution among well-known actors on the BiH political scene is again crucial point for the elections in Mostar not to be called again even 12 years after the last elections were held,” the DF states.

The judgment of the European Court of Human Rights "Baralija v. Bosnia and Herzegovina", as pointed out by the DF, ordered Bosnia and Herzegovina to amend the Election Law within six months from the day this judgment becomes final in order to enable local elections to be held in Mostar.

DF said that if the state does not do that, the European Court of Human Rights concluded that the Constitutional Court of BiH, according to the domestic law and practice, is authorized to adopt temporary rules as necessary transitional measures.

Considering that it cannot be expected that a political agreement on the elections for the City Council of Mostar will be reached in the Parliament in the near future, we call on the Constitutional Court of BiH to adopt temporary rules for holding elections for the City Council of the City of Mostar as it was stated in the judgment of the European Court of Human Rights in the case of "Baralija v. Bosnia and Herzegovina", it is said in the statement of the DF.
