Džaferović: Dodik's action at BiH Presidency session means obstruction

SARAJEVO, February 19 (FENA) – BiH Presidency member Šefik Džaferović confirmed to reporters in Sarajevo today that today's session was not effective as only one out of 14 items and 19 ratification agreements from the agenda was adopted.

This means that all items on the agenda will go to the second round of voting, and they are all about foreign policy, appointment of honorary consuls, decisions on granting consent, as well as several important agreements for BiH. Džaferović also confirmed that Dodik would raise the issue of vital national interest concerning the visit of the President of Montenegro to BiH.

Also, items on the agenda regarding the Armed Forces have not been adopted because Dodik voted against them, and these decisions have to be made unanimously.

Džaferović said that this is an obstruction in functioning of BiH institutions, because there is no other way to name this situation when Dodik voted against ratification of international agreements that have passed the entire prescribed procedure.

He explains that this also means an obstruction of the Dayton Peace Agreement and urged Republika Srpska's political representatives, including Dodik, not to do so, because it would ultimately be to the detriment of the entities, since BiH existed before Dayton and will continue to exist if there is no Dayton.

“I urge the RS political representatives to be careful what they do and to respect the Dayton Peace Agreement, but to respect all points and if something will be changed it must be changed in whole or it will not change at all. BiH will not suffer the damage,” Džaferović said.

He believes that in fact, there is an attempt to forcefully, under threat and blockade, find a solution that could lead BiH into disintegration, because it is not by chance that three judges of the Constitutional Court are those who are not citizens of BiH or neighboring countries.  

He explained that foreign judges are appointed by the President of the European Court of Human Rights and it enables BiH to function.

“In a situation of blockades and threat of dissolution of BiH, it is difficult to change anything, and then to demand that foreign judges leave the Constitutional Court and never change anything else, we will never agree to that. We can talk, but only if we will change other provisions from the Constitution such as entity voting,” Džaferović said.

He added that Dayton is much more than 11 annexes, Dayton is also the European Convention and decisions of the courts and several hundred laws that were passed after the Dayton Peace Agreement was signed.

He also said that he does not think that it is only possible by the Law on the Constitutional Court to change the composition of that court, the only thing that the Constitution allows is to consider the way and appointment of foreign judges.

BiH Presidency member Milorad Dodik demanded that the Presidency consider today the appointment of a new foreign judge appointed by the European Court of Human Rights, claiming that the nomination proposal had not been made available to him, Presidency Chairman and member Željko Komšić and Šefik Džaferović rejected that proposal.  

Džaferović rejected claims that he had informed Dodik about the matter, stressed that neither he nor anyone in his Cabinet had discussed it, and recalled that a procedure for appointing a foreign judge had been initiated earlier because mandate for one of the incumbent judges is expiring on April 25.

“All three members of the BiH Presidency had the opportunity to react independently or within the institution, which is why I do not think that Komšić deceived anyone,” Džaferović emphasized.

He also referred to defining entity line, saying that it had been identified and was part of Dayton, but he did not know why it was insisted on being marked on the ground because this was not possible since it was a direct matter prescribed in Dayton, adding that there were no physical marks and they are prohibited by Annex II.

The session of the Presidency of Bosnia and Herzegovina scheduled for today was the first session after the National Assembly of Republika Srpska adopted several conclusions concerning the Constitutional Court of BiH.
