Džaferović: RS emerged as a difficult compromise in Dayton

SARAJEVO, February 17 (FENA) - What Republika Srpska's political representatives are doing is a path to destabilization, endangering the Dayton Peace Agreement and peace, BiH Presidency member Šefik Džaferovic told reporters in Sarajevo today.

Commenting on the conclusions proposed for adoption by the Republika Srpska National Assembly on the Constitutional Court of BiH, Džaferović stressed that the RS and its officials have strong interest in remaining strictly abiding by the provisions of the Dayton Peace Agreement and not making any move that would jeopardize it.

“Republika Srpska was created by the Dayton Peace Agreement, regardless of the genocide, mass crimes, ethnic cleansing in the territory of that BiH entity, in order to restore peace and give the country a chance to reintegrate in peace. Entity Republika Srpska emerged as a difficult compromise in Dayton,” Džaferović reminded.

He therefore assessed that the political representatives of that BiH entity are going in a completely opposite direction, and urged them not to do so but to strictly respect the Dayton Peace Agreement and the obligations arising from it.

Džaferović said that judges in the BiH Constitutional Court, appointed by the President of the European Court of Human Rights, are part of the so-called Dayton balance, which is just as important part of the Dayton Peace Agreement and the BiH Constitution as entity voting and entities.

He stressed that insisting on the Constitutional Court of BiH without foreign judges means insisting on a disturbance of the Dayton equilibrium, which puts BiH in a situation where it cannot function, and Džaferović announced that it would never be accepted.

He estimated that the Office of the High Representative (OHR) in BiH should have responded a long time ago, emphasizing that BiH would not be in this situation today if the OHR had reacted to such and similar speeches. He also points out that the ineffectiveness or weakening of the role of the international community is being encouraged by anti-Bosnian political forces.

“Nothing will be achieved with this pressure. We cannot discuss anything in a situation where there is pressure, threat, blackmail and blockade of BiH institutions,” Džaferović added, urging RS political representatives to go back and start working in BiH institutions because there are numerous mechanisms that can protect all interests.

As he concluded, even if the deputies of the National Assembly of Republika Srpska (RSNA) adopt the conclusions at today's session, they cannot produce any legal effect because BiH functions on the basis of the Constitution of BiH, not on the basis of the unconstitutional conclusions of the RSNA.
