SARAJEVO, February 5 (FENA) – Constitutional Court of the Federation of Bosnia and Herzegovina requested from the Office of the President and two Vice-Presidents of the Federation of BiH in November and January regarding the process of appointing judges to the Constitutional Court, since the process was blocked and the institution lacks four judges.
Since, even after two urgent requests, President of the Federation of BiH Marinko Čavara did not submit the list to Vice Presidents Melika Mahmutbegović and Milan Dunović for approval, today they sent a letter to FBiH President Marinko Čavara requesting to end the process as soon as possible.
“We request that you appoint judges from the submitted list of candidates, in accordance with the joint proposal of the two vice-presidents for the two judges, and forward this to us for approval, so that the final proposal can be submitted to the House of Peoples of the Federation of BiH to confirm the appointment,” it is said in a statement.
As Vice President Melika Mahmutbegović told FENA, it is unclear why this appeared to be a problem as they completed the procedure.
“The Constitutional Court currently lacks four judges, two from the Bosniak caucus, one from the Croat caucus, while applying procedure is underway to appoint one judge from the Serb caucus,” added Mahmutbegović.
“This is why requests were sent to President Marinko Čavara to speed the process. Since President Čavara's silence is unclear to me, today we have again written and urged him to finally approve the list of candidates in order to send this to the House of Peoples for the final appointment of judges,” said Mahmutbegović.
This would eliminate the current serious problem with regard to the FBiH Constitutional Court, which is now difficult or almost impossible to function, Vice-President of the Federation of Bosnia and Herzegovina Melika Mahmutbegović concluded in an interview with FENA.
