Pivić: It is unacceptable for HJPC president not to show up at BiH PA sessions

SARAJEVO, January 19 (FENA) -Deputy Minister of Justice of Bosnia and Herzegovina Nezir Pivić, said that even though the BiH Parliamentary Assembly only takes note of the report of the High Judicial and Prosecutorial Council (HJPC) without being able to influence the Council's work itself, it is unacceptable for the second time in a row, that the HJPC President Milan Tegeltija decides not to attend the scheduled session despite the fact he was duly summoned.

Pivić in his statement on the absence of the HJPC President at the session of the House of Representatives of the BiH PA, where the Report on the work of that Council is discussed, recalls that the BiH Parliamentary Assembly every year considers the annual report on the work of the High Judicial and Prosecutorial Council (HJPC).

He notes that, in addition to submitting a formal report, which is the basis for the analysis and discussion of MPs, it is standard practice for the head of the institution submitting the report to be present at the session and present its key parts.

Pivić states that in this way, MPs have additional insight into the work of the institution so that they can give an overview and analyze more deeply the potentially unresolved issues. Thus, the basic function of the work of institutions is manifested, namely in legality and above all, in transparency.

"Although the BiH PA merely takes note of the HJPC report, without the ability to influence the very work of the HJPC itself, it is unacceptable that the HJPC President does not attend the scheduled session for the second time in a row. In this way, he not only shows disrespect the legislative power, which is separate from the judicial once, but also he grossly violates the principle of transparency of the judicial system, as one of the three pillars of state power," Pivić points out.

This, he underlined, also grossly undermines, above all, citizens' confidence in the work of the justice system, because they are left out of the possibility of analyzing and problematizing all aspects of the work of the judiciary through their elected representatives.

"The HJPC as an umbrella institution representing the judicial system, which is one of the three pillars of state power, separated from the legislative and executive ones in order to preserve its impartiality and independence, should not be exempted, that is, singled out from the possibility of public scrutiny and transparent review of its work, The rejection of the said report by the House of Representatives of the BiH Parliamentary Assembly, as well as the expressed distrust of citizens in the work of the judiciary, as well as the report of independent expert Reinhard Priebe, all point to the fact that the leadership and members of the HJPC should resign," concluded Pivić.
