BiH PA HoR Constitutional Committee upholds several law proposals

SARAJEVO, December 30 (FENA) - Members of the Constitutional Committee of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina have determined at today's session in Sarajevo that several law proposals submitted by the BiH Council of Ministers have been aligned with the BiH Constitution and the legal system.

Members of the Committee from the Croat Democratic Union (HDZ) and the Serb Democratic Party (SDS) Nikola Lovrinović and Dragan Mektić have suggested that the newly-convened Council of Ministers consider these laws, since they are amendments to laws proposed since the previous convocation.

There is alignment with the Constitution and the legal system, the Committee believes when it comes to amending the Law on Financing of Institutions, which refers to the introduction of budgetary inspection. The law was passed in 2004 and has already undergone several amendments.

The Collegium of the House of Representatives was asked to extend the deadline for submitting opinions on amendments to the Law on Execution of Criminal Sanctions, which are necessary due to the construction of the state prison, and after the remark of a member of the Committee from the Alliance of Independent Social Democrats (SNSD), Nebojša Radmanović, that the amendments override the jurisdiction of the entities and have asked the opinion of the Ministry of Justice.

The amendments to the Law on Excise Duties and the amendments to the Patent Law proposed by the Council of Ministers are in accordance with the Constitution and the legal system of BiH, the Commission believes, and these are amendments that mean the harmonization of those laws with EU directives.

The Committee supported the amendments to the Judicial Police Law concerning better specifying police competences, labor status and police powers were because certain difficulties arose in the application of the law.

Democratic Front (DF) MP Zlatan Begić called for changes to the Law on citizens' permanent and temporary residence, assessing today that the amended provisions of the 2015 law pose a problem in practice, as there are times when certain persons cannot obtain an ID.

Explaining the reasons for the change, he stated rigid conditions for registering a residence since the residence cannot be registered for and consequently an ID issued if the person does not own the property or is not married to the owner of the property in the entity.

This represents a problem because in BiH, which is no exception, there is large number of illegal housing where people live but cannot register their residences. In this regard, he cited the Municipality of Novo Sarajevo as an example, with 4,500 illegally constructed housing facilities and 1,700 were negatively evaluated.

However, Radmanović said the changes that Begić proposes would open up the possibility of abuse, which Begić said is still the case because people cannot register these addresses because of these problems, even though there are housing objects where people live that are numbered.

On the other hand, the law also provides for sanctions against potential abuse, and Begić says he would also agree to stricter penalties in the legislative process of passing the law.

Following the discussion, the Committee concluded that the amendments to the Law were in accordance with the BiH Constitution and the legal system and would also be referred to the House of Representatives for consideration.
