Ruling majority in RSNA adopts 20 conclusions

BANJA LUKA, November 12 (FENA) - The ruling majority in the Republika Srpska National Assembly (RSNA) adopted 20 conclusions, including the one that promotes the right of all peoples to self-determination, and announces a new RS constitution which citizens will be able to vote in a referendum, in case of the absence of reaction to attempt the degradation the Dayton Peace Agreement.

"In case of a denial of the right of peoples to self-determination proclaimed by the UN Charter and further support for activities leading to degradation of the Dayton Peace Agreement, the RS keeps the right to finally decide on its future status," it is said in the conclusions of SNSD, DNS, Socialist Party, DEMOS, United Srpska and NDP.

After 15 hours of discussion on the Information on "Unconstitutional transformation of the Dayton Structure of BiH and impact on the position and rights of the RS", the deputies adopted early this morning at 03.30 the conclusion that the entity parliament would continue to act in accordance with the resolution on protection of constitutional order and military neutrality by which the RS committed itself.

Cooperation with NATO and its key members on security issues has been supported, but not BiH's membership in NATO, primarily because the formation of a NATO border with the Republic of Serbia is unacceptable, as well as the enormous costs that joining the Alliance would entail for RS and BiH.

In case of violent attempts of Bosnia and Herzegovina's accession to NATO, RS will hold a referendum at which citizens will decide RS's membership in any military alliances, it is said, among other things, in the conclusions voted by 53 deputies, no one was against or restrained.

The National Assembly asked the Government to analyze the effects of unconstitutional transfers of competences from entities to the level of BiH, including competences transferred through the so-called inter-entity agreements in the field of defense and indirect taxes, and to inform the National Assembly accordingly, with the aim of initiating discussions between the entities and the legitimate representatives of the constituent peoples to review their effectiveness.

In particular, the RS National Assembly obliges the Government of the Republika Srpska with preparing for eventual separation from the VAT system of BiH and opening of a special account for RS VAT, since the work of the Indirect Taxation Authority of BiH, as well as the way of allocating of the collected funds, causes damage to RS and its citizens, it is stated in the adopted conclusions.

The RS Government is requested to open negotiations with the Government of the Federation of BiH in order to urgently harmonize the Law on the Constitutional Court of BiH, then advocate for reform of the judiciary institutions, the question of content and mode of work of the Constitutional Court of BiH, abolition of the OHR, reject the Bonn Powers of the High Representative as totally unconstitutional, illegal and illegitimate ...

Deputy of the caucus of “Together for BiH” in the RS National Assembly, Begija Smajić, warned that the "Information on the unconstitutional transformation of the Dayton structure of BiH and its impact on the position and rights of the RS" offends the victims of genocide, including her.

She also questioned when the law to ban genocide denial would be passed and called on the High Representative to do so if domestic politicians are not prepared to do it.

The scheduling of a special session with a proposed agenda item was requested by the signatures of one-third of the members of the ruling majority in the RS.
