Čavara: ECHR decision upholds the decision of BiH Constitutional Court

STRASBOURG, October 31 (FENA) - FBiH President Marinko Čavara told FENA in Strasbourg today that the Council of Europe's Congress of Local and Regional Authorities has raised concerns that, after so many years, the citizens of Mostar cannot express their democratic will and elect.

Speaking after the end of the three-day Congress, Čavara said that it is necessary to implement the decisions of the Constitutional Court of BiH on the Statute of the City of Mostar and the electoral law that would allow elections to be held.

The judgment of the European Court of Human Rights following a lawsuit filed by Irma Baralia for failing to hold elections in Mostar coincided with holding of Congress of Local and Regional Authorities. Čavara says the decision of the European Court only upholds the Constitutional Court's decision that it should find a way to change the election law as soon as possible and allow elections to be held in Mostar next year. One possibility is to hold elections in Mostar as in all cities and municipalities in BiH or to create a model that will be applicable to all other cities and municipalities.

The Congress of Local and Regional Authorities today adopted a report on local and regional democracy in BiH. Some of the criticisms related to ambiguities in competencies between different levels of government, especially in the Federation of BiH.

"The biggest problem is relation between regional authorities, entities and cantons, since the Constitution does not specify when and how authorities can decide on some issues that are jointly in competence between the Federation of BiH and cantons, which creates big problems," Čavara said.

“There are many details that need to be clarified. Each law must reduce these dilemmas, and when and if constitutional changes occur, it should be fully defined and perhaps even clearly restricted as to whose competence is in the area of the division of power between the FBiH and cantons,” concluded Čavara in an interview for FENA in Strasbourg.
