Genjac to PIC ambassadors: SDA remains firmly committed to the BiH Constitution

SARAJEVO, September 20 (FENA) - Secretary-General of the Party for Democratic Action (SDA), Halid Genjac, sent a letter to the ambassadors of member states of the PIC Steering Board in Bosnia and Herzegovina in connection what he said was a propaganda campaign launched in recent days by the RS entity and Serbia, on the occasion of the adoption of the SDA Program Declaration at the 7th Congress of the party held on September 14 in Sarajevo.

Even though there are absolutely no valid arguments, Genjac noted, some have persistently tried to portray this Declaration as anti-Dayton activity and even a threat to stability and peace.

"The goal of such propaganda and political pressure is to blame the SDA for what the political forces who accuse us of anti-Dayton activities are in fact doing themselves," he said.

According to him, the Declaration promotes identical provisions on constitutional reforms as well as program declarations adopted at previous congresses (2015, 2009, etc.)

The SDA program declaration, he added, advocates a legitimate aim - to reform the Constitution of Bosnia and Herzegovina with the aim of ensuring equality for all citizens of Bosnia and Herzegovina through the full implementation of the European Convention on Human Rights.

This is ultimately the obligation of all in BiH, based on the judgments of the European Court of Human Rights and the European Commission's Opinion on BiH's application for EU membership.

“Therefore, the SDA does not threaten anyone, does not intend to violate the existing Constitution, nor does it plant to reach its legitimate goal (Republic of Bosnia and Herzegovina, the state of equal citizens) by taking unilateral and unlawful actions.

The existing BiH Constitution states that constitutional reform requires a two-thirds and an entity majority in the BiH Parliamentary Assembly. The only way to change the organization of BiH, therefore, is through political dialogue and consensus of representatives of all peoples and citizens, as stated in the preamble to the Declaration.

The SDA remains firmly committed to complying with the existing Constitution and laws until consensus is reached on changing them. We have also shown this in the past with our principled commitment to respect for the rule of law.

Compliance with the Constitution and the laws is the basis of our position when it comes to the formation of government. If we were to give up the legal obligations with regards to the Annual National Program with NATO would mean that the laws and decisions of the institutions in this country must not be respected or that they can be selectively respected - as anyone sees fit. A complete destabilization would follow bringing anarchy because, in the end, we would have the established institutions of government whose decisions would be non-binding in the future,” stressed Genjac.

Contrary to this commitment for the respect of the Constitution and all the laws, Genjac stresses there are political forces, led by the SNSD president, who have been persistently in systematically undermining the Dayton Peace Agreement for more than a decade.

“Ever since the collapse of the April constitutional reform package, Milorad Dodik, in coordination with power centers outside BiH, has intensified separatist political activities that threaten to undermine peace and stability not only in BiH, but throughout the region.

For more than a decade, Dodik has been insulting the state of Bosnia and Herzegovina on a daily basis, calling it a failed, impossible, rotten state, threatening with secession referendums, and publicly advocating the annexation of the RS entity to Serbia. He has continuously tried to impose the will of the entity onto the state in areas for which the state has exclusive jurisdiction. At the same time, he has continued to deny the Bosniak people their constitutionally guaranteed right to the Bosnian language, he has insulted Bosniak returnees by calling them "occupiers of Podrinje".

Dodik with his insults did not even spare the High Representative or the ambassadors (USA, Germany…). In addition, Dodik constantly denies the genocide in Srebrenica and the judgments of international courts, awarding decorations to convicted war criminals. A student dorm in Pale was named after one of them - Radovan Karadžić. He is now again threatening to unilaterally reinstate the entity authority over the state’s and he attacks the BiH Armed Forces, the Indirect Taxation Authority and judicial institutions,” Genjac wrote in his letter.

Genjac underlined that it is high time to stop treating all these connected actions and campaign as some unrelated incidents, rather than as a systematic implementation of previously established policies, apparently coordinated with centers outside BiH.

“I use this opportunity to remind you of the Declaration of the 5th Assembly of the Alliance of Independent Social Democrats (SNSD) held in 2015, in which they proclaimed the secession of BiH as the goal of the RS entity, as well as the 2013 declaration of the Serbian Progressive Party (SNS), which cites the annexation of Bosnia’s entity of RS to the neighboring Republic of Serbia.

I would also like to draw your attention to indicative reactions from the Republic of Serbia, which as a side that was involved in the war in BiH (legal successor of FR Yugoslavia) is a signatory to the Dayton Peace Agreement. Serbian officials have had absolutely inappropriate reactions to the SDA Declaration and the alleged threat to the Dayton Agreement.

At the same time, in cases where the Dayton Peace Agreement is indeed violated by unilateral actions from the RS entity, to which the Peace Implementation Council has warned for years, there have been no reactions and condemnation from Serbia. On the contrary, very often Milorad Dodik's political behavior has been directly or tacitly endorsed and supported,” concluded Halid Genjac, SDA Secretary-General.
