Komšić: By accepting EC Opinion, HDZ rejects constitutiveness

SARAJEVO, August 15 (FENA) - Bosnia and Herzegovina Presidency Chairman Željko Komšić said that by accepting the Opinion of the European Commission, the Croatian Democratic Union (HDZ) BiH has finally, knowingly or unknowingly, rejected the anti-European, civilizationally and historically backward concept of the so-called constitutiveness of the people.

“At this point, it is less important whether or not they are aware in the HDZ that, by accepting the EC Opinion, even declaratively, they have forever inflicted a final defeat against the ethnic basis of their own politics. In the world of facts, the HDZ's declaratory assent to the EC Opinion on the election legislator means only one thing. Rejecting the backward Soviet principle of constitutiveness of the people, as the EC Opinion relies on the relevant judgments of the European Court of Human Rights. It is in one of these judgments, in particular in the Zornić case, that the European Court of Human Rights orders the constitution to be rejected, stating that genocide and ethical cleansing must have been consented to in the electoral law, and that, as the Court dictates, it was time that this principle is rejected in BiH's electoral legislation,” Komšić said in a statement today.

He points out that "it is more than clear that the EC Opinion, based on the judgments of the EU court, sealed the fate of HDZ's demands for strengthening the ethnic electoral model."

If the EC Opinion is consistently implemented, Komšić believes that a possible change in the electoral legislature, on the recommendation of the European Commission, can only go in the direction of strengthening the civic and not ethnically-constitutive principle, which is the principle of segregation and further strengthening of discrimination.

“In accordance with the competencies that I have as a member of the BiH Presidency, I will do my best to implement the recommendations of the European Commission Opinion in BiH as quickly and consistently as possible. No meeting with EU officials and EU representatives in BiH will take place without me advocating for speeding up the process, which must inevitably lead to the rejection of constitutiveness and the introduction of equality and equal value of the voice of all citizens. I am convinced that the EU will finally endorse to advocate a civic concept in BiH at the expense of the ethnically constitutive. After all, those are the recommendations and measures from the Opinion,” Komšić adds.

All this, in his words, is more reason for the pro-Bosnian civic parties, and especially for the parties to the left of the center (Our Party and SDP), to finally, see the new reality created by the EC Opinion, make a radical break with the policy of reconciliation between the ethnic and civic concept, because there can and will not be a compromise in the future.

He concluded that for a civic BiH one can only advocate an entirely civic concept and not the reconciliation concept of the two things that are irreconcilable -the ethnic and the civic.
