Tegeltija: Problem of missing system of background checks

SARAJEVO, August 9 (FENA) – On the occasion of the memo sent by the Head of the EU Delegation and EU Special Representative to BiH Lars Gunnar Wigemark, which was sent on August 1 to the High Judicial and Prosecutorial Council of BiH (HJPC) regarding the problem of extending the mandate to the additional judge of the Cantonal Court in Sarajevo Husein Delalić, the President of HJPC Milan Tegeltija responded to Wigemark today and said that he “entirely shares his concerns.”

“However, I want to notify you that in late 2017 I publically pointed to the problem of the non-existence of a system of background checks when making the decision of appointing judges and prosecutors and I was afraid that this might happen.  That is why we insisted on incorporating a background check system into the system of appointing judges and prosecutors. On this occasion, the High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJPC) also reached conclusions which, at that time, were challenged by the public, probably due to a lack of understanding of the depth of the problem and of all the consequences that this lack of system can produce,” Tegeltija stressed.

With regard to the extension of the mandate of this additional judge, Tegeltija informed Wigemark that this was not an appointment undergoing application procedures, but an extension of the mandate.

Tegeltija informed Wigemark that during the procedure of the extension of the mandate, additional information about ongoing disciplinary proceedings and the subject matter of these disciplinary actions are not an integral part of the checks for additional judges’ mandates, and that all this resulted in the extension of Delalić's mandate.

“This case points to a serious and deep problem of the missing background check that we have been highlighting since 2017, and I hope that this will be an additional motive and an incentive for this extremely important issue to be resolved quickly and with good quality in order to avoid such cases in the future,” Tegeltija said in a response to Wigemark, the HJPC BiH said.
