Dragan Janjić sentenced to seven years in prison for wartime rape in Foča

SARAJEVO, July 18 (FENA) - The Panel of Section I for War Crimes of the Appellate Division of the Court of Bosnia and Herzegovina sitting in the criminal case of Dragan Janjić, after deliberation and vote rendered, and, on 18 July 2019, pronounced a Judgment finding the Accused Dragan Janjić guilty of the criminal offense of Crimes against Humanity in violation of Article 172(1)(g) of the Criminal Code of Bosnia and Herzegovina (CC B-H), as read with Article 180(1) of the CC B-H.     

The Accused Dragan Janjić was found guilty of the following: in the period from early April 1992 to late September 1992, during which a widespread and systematic attack was carried out by the military, paramilitary and police forces of the so-called Serb Republic of Bosnia and Herzegovina, afterward Republika Srpska, against the Bosniak civilian population of the Municipality of Foča, knowing of that attack and that his acts constituted a part thereof, as a member of the police force of the so-called Serb Republic of Bosnia and Herzegovina, afterward Republika Srpska, with the use of force and threats he raped a civilian person.

The Court imposed on the Accused Dragan Janjić a sentence of imprisonment for the term of 7 (seven) years

Pursuant to Article 56 of the CC B-H, the time the Accused will have spent in custody as of 3 November 2017 shall be credited toward the pronounced prison sentence.

Pursuant to Article 198(2) of the Criminal Procedure Code of Bosnia and Herzegovina (CPC B-H), the Court awarded the injured party a part of the claim under property law, whereby the Accused Dragan Janjić must pay to the injured party the total of 15,000.00 KM as non-pecuniary damage within the period of 30 (thirty) days from the day the Judgment becomes final and binding, or face forcible collection. With respect to the remaining part of the claim, the Court referred the injured party to take civil action.

Pursuant to Article 188(4) of the CPC B-H, the Accused is relieved of the duty to cover the costs of the criminal proceedings.

No appeal lies from this Judgment.
