SARAJEVO, July 18 (FENA) - The High Judicial and Prosecutorial Council (HJPC) of Bosnia and Herzegovina adopted, on the second day of the session, the Conclusions as a response to the Conclusions of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina adopted at a session of the House of Representatives held on June 26.
The conclusion of the HJPC BiH states that the conclusion of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina, which requires all members of the High Judicial and Prosecutorial Council of BiH to resign, does not in any way oblige the members of the HJPC.
The conclusion of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina, which establishes the investigative commission of the House to investigate the situation in the judiciary, and in particular the High Judicial and Prosecutorial Council, essentially represents a case of parliamentary oversight of the work of the judiciary which, as such, has not been foreseen and allowed by the regulations in Bosnia and Herzegovina, it is said in the conclusion of the HJPC.
By doing this, the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina steps out of the jurisdiction of the Parliamentary Assembly, and it represents a gross interference and undue pressure from the legislative branch onto the work of the judiciary, and as such it violates the democratic constitutional order of the three-way division of power,” said the HJPC.
It is also noted in the conclusion that the HJPC members, judges and prosecutors in Bosnia and Herzegovina, will in no way participate in the work of this inquiry commission of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina, it is said in the conclusion of the HJPC BiH.
