Adamović: Problems are the result of inadequate application of the Law on HJPC

SARAJEVO, June 2 (FENA) - Former judge of the Court of Bosnia and Herzegovina and the Supreme Court of the Federation of Bosnia and Herzegovina Vlado Adamović stated today that BiH has legislation that provides preconditions for the judiciary to be separate from politics, and that what has been currently registered as a major problem is a consequence of inadequate application of the Law on the High Judicial and Prosecutorial Council of BiH.

Speaking as an introductory speaker at the session of the Association of Independent Intellectuals Circle 99 on the topic of "Failure/Success of Judicial Reform in BiH", Adamović said that judges in BiH began reforms with the help of foreigners, although many think that it was the opposite, but did not implement them in all the necessary stages and in a satisfactory manner.

"I appeal to judges and prosecutors to correct their behavior and start from the beginning to bring judicial power in BiH closer to European standards," said Adamović.

He added that courts recently have issued a large number of acquittals or rejected requests for prosecution, which is a sign that the indictments are not good enough, and the general opinion is that the prosecutor offices are currently the weakest link in the system.

"However, the courts have a special responsibility as there are preliminary hearing judges and a preliminary proceeding, which is the control of the investigation and the indictments filed, and there are mistakes present because the indictments that are often confirmed should not be because of procedural ommissions," explained Adamović. 

Asked about the possible return of foreign judges and prosecutors into BiH judicial institutions, Adamović said there was no need for that.
