Indictment in Ćamil Ramić et al. case confirmed under war crimes charges

SARAJEVO, February 5 (FENA) - On 18 January 2019, the Court of Bosnia and Herzegovina confirmed Indictment against the accused in Ćamil Ramić et al, with the following charges:

-           Ćamil Ramić, by the acts described in Counts 1 and 2, committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)(a) as read with Article 180(2) of the Criminal Code of Bosnia and Herzegovina (CC BiH),

-           Mehmedalija Topalović, by the acts described in Counts 3 and 4, committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)(a) as read with Article 180(1) of the CC BiH, all in conjunction with Article 29 of the CC BiH,

-           Himzo Selimović, by the acts described in Counts 6, 7, 8 and 9, committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)(a) as read with Article 180(1) of the CC BiH; and, by the acts described in Counts 5, 10, 11 and 15, committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)(a) as read with Article 180(1), all in conjunction with Article 29 of the CC BiH,

-           Ramiz Mićivoda, by the acts described in Counts 10, 11 and 12, committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)(a) as read with Article 180(1) of the CC BiH, all in conjunction with Article 29 of the CC BiH,

-           Mustafa Stovrag, by the acts described in Count 13, committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)(a) as read with Article 180(1) of the CC BiH, all in conjunction with Article 29 of the CC BiH; and, by the acts described in Counts 14 and 15, committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)(a) as read with Article 180(1) of the CC BiH.

According to the Indictment, the accused:

-           Ćamil Ramić, as Chief of Security of the Višegrad Municipality Territorial Defense Staff from June 1992 until the end of October 1992 and as Assistant Commander for Security at the 1st Višegrad Brigade of the Army of Bosnia and Herzegovina (BiH) from the end of October 1992 until February 1993,

-           Mehmedalija Topalović, as a member of the Army of BiH,

-           Himzo Selimović, as a member of the security organ of the IBOG /Eastern Bosnia Operations Group/ from the end of January 1993 to April 1993 and as Assistant Commander for Security at the IBOG from April 1993 until the end of October 1994,

-           Ramiz Mićivoda, as Deputy Commander of the IBOG Military Police Company, and

-           Mustafa Stovrag, as a member of the MUP RBiH /Ministry of Interior of the Republic of Bosnia and Herzegovina/, Goražde SJB /Public Security Station/,

During the war in BiH and the armed conflict between the Army of BiH and the Army of the Republika Srpska (VRS)in the territory of Rudo, Višegrad, Goražde and Foča municipalities, in the time period between October 1992 and November 1995, as members of the Army of BiH and Mustafa Stovrag as a member of MUP RBiH- Goražde SJB, when conveying VRS prisoners of war from Strmica to Brodari (Višegrad municipality), in an improvised military prison of the Army of BiH in Kaoštice (Međeđa, Višegrad municipality) located in the house of Nedžib Hurem and on the premises of the Military Remand Prison of the IBOG of the Army of BiH located in the building of former ZOIL in Goražde, failed to act in compliance with the rules of international humanitarian law and violated the provisions of Article 3(1)(a) of the Third Geneva Convention relative to the Treatment of Prisoners of War of 12 August 1949 and Articles 86 and 87 of Additional Protocol I by perpetrating deprivation of liberty and other inhumane acts of a similar character with the intent to cause great suffering or serious injury to body or to physical or mental health, stated the BiH Court.
