Džaferović: Norms from FBiH Constitution need to become part of Election Law

SARAJEVO, November 20 (FENA) - The BiH Presidency Member and Vice President of the Party of Democratic Action (SDA) Šefik Džaferović told reporters today in Sarajevo that he advocates for true equality of the three peoples in BiH and that this is just what is envisaged through the House of Peoples of the FBiH Parliament for all three peoples.

Responding to journalists' questions about the arrangement of relations with Croats within the Federation of BiH, Džaferović stated that he firmly believes that "we need to strictly respect what we have now as rules on issues of constitutiveness, relations between peoples and equality."

In his words, the matter of equality of constituent peoples was one of the main concern even in Washington, and then later in Dayton and in all the reforms that were subsequently adopted in the country.

Džaferović believes that a problem for BiH is inequality of citizens who do not belong to any of the constituent peoples.

"This is something we have as an obligation to correct based on several judgments of the European Court of Human Rights. When it comes to the relations between the constituent peoples, the position of each of the constituent peoples, and the relations between the Croat and Bosniak peoples in the FBiH, we have mechanisms that can protect the vital interests of all peoples," Džaferović emphasized.

He added that these are the mechanisms through the houses of peoples, with the proper control by the Constitutional Court.

"Anything else that could be introduced and what we hear as requests, actually lead to something else. In my opinion, this does not concern the issue of equality. This falls within the sphere of some kind of domination of one people, or of a political party in relation to the entire political structure in the Federation of BiH and in the country as a whole. I am for the true equality of all three peoples, and this is what is envisaged through the House of Peoples of the Parliament of the FBiH. But I am not in favor of the behavior which, under the guise of the fight for the rights of constituent peoples, in fact, is searching for ways to ensure that some political parties would forever remain in power," said Džaferović.

He noted that anyone who wants to be well-intended towards every people and every citizen in this country will not be able to draw a different conclusion to the one he just presented.

"The judgment of the Constitutional Court in the Ljubić case has been misinterpreted. Absolutely wrongly interpreted. We have the Constitution of the Federation of BiH, we have a clear norm and we need to include this norm from the Constitution of FBiH in the Election Law of BiH. I do not know where the problem might be then? Is there any issue or a question of vital national interest important to the Croat people on which someone can outvote the Croat representatives?" asked Džaferović.

He stresses that there is no such issue because there are mechanisms that do not allow this to happen. This is ensured, as he explains, by the majority vote needed in every club in the House of Peoples after the Constitutional Court of the Federation of BiH rules that this is a matter of vital interest.

"It is a democratic standard beyond which we can go no further. Everything else leads to additional ethnic divisions in this country," Džaferović underlined.
