Indictment confirmed in Dušan Kuzmanović et al. case for war crimes in Teslić

SARAJEVO, September 12 (FENA) - On 6 September 2018, the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Dušan Kuzmanović, Predrag Markočević and Marinko Đukić with the criminal offense of Crimes against Humanity under Article 172(1), Subparagraphs a), e), f), h) and k), as read with Articles 29 and 180(1) of the Criminal Code of Bosnia and Herzegovina. 

The Indictment alleges that the accused, between April and late December 1992, during the armed conflict in Bosnia and Herzegovina, within a widespread and systematic attack launched by military and police forces of the Serb Republic of Bosnia and Herzegovina, subsequently Republika Srpska, aimed against Muslim and Croat civilians in the Teslić municipality, knowing of the attack and that their actions constituted part of the attack, Dušan Kuzmanović as the Head of the Teslić Public Security Station and a Teslić Municipality Crisis Staff member; Predrag Markočević, as commander of the Teslić Public Security Station; and Marinko Đukić, as the Head of Criminal Department of the Teslić Public Security Station, all of them as superior officers at the Teslić Public Security Station, managed and supervised members of the regular and reserve members of the Teslić Public Security Station, who have, together with a detachment of the military-police formation known as Miće, arrived there following a call sent by members of the Teslić Crisis Staff to the Crisis Staff of the Serb Municipality of Doboj, at the orders of the Crisis Staff of the Serb Municipality of Doboj, with the aim of helping the realization of strategic goals of the Serb people in Bosnia and Herzegovina, which is a detachment that since 3 June 1992 operated within the Teslić Brigade Military Police Company of the Army of Republika Srpska, and the civilian and military leadership of the Teslić municipality, acting with discriminatory intent to achieve the common goal to implement the state policy planned by the Decision on Strategic Goals of the Serb People in Bosnia and Herzegovina, adopted on 12 May 1992 by the Assembly of the Serb Republic of Bosnia and Herzegovina, and carry out a persecution of Muslim and Croat population on ethnic and religious grounds, and since the first strategic goal - “separation from the two other ethnic communities – state separation” – implied a permanent removal of a major part of the Muslim and Croat population from the territory of the envisioned country of Bosnian Serbs, so with the aim of realizing that goal they knowingly participated in planning, preparing and carrying out the persecution of Muslim and Croat civilians in the Teslić municipality on national, ethnic and religious grounds, as follows:

• by actions listed under Counts 1 and 2 of the Indictment, imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law, intentional infliction of severe bodily or mental pain or suffering and other inhuman acts of similar nature, committed with the intention to inflict great suffering or serious physical or mental injury or violation of health,

• by actions listed under Counts 3, 4 and 5 of the Indictment, depriving the life of another person, by imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law, intentional infliction of severe bodily or mental pain or suffering and other inhuman acts of similar nature, committed with the intention to inflict great suffering or serious physical or mental injury or violation of health,

• by actions listed under Count 6a) and 6b) of the Indictment, Dušan Kuzmanović alone committed intentional infliction of severe bodily or mental pain or suffering and other inhuman acts of similar nature, committed with the intention to inflict great suffering or serious physical or mental injury or violation of health,

• by actions listed under Count 7 of the Indictment, Predrag Markočević alone committed imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law, intentional infliction of severe bodily or mental pain or suffering,

• by actions listed under Count 8a) and 8b) of the Indictment, Marinko Đukić alone committed intentional infliction of severe bodily or mental pain or suffering and other inhuman acts of similar nature, committed with the intention to inflict great suffering or serious physical or mental injury or violation of health, stated the BiH Court.
