Venice Commission experts to meet with party leaders in early June

SARAJEVO, May 24 (FENA) - Experts of the Venice Commission, who today met in Sarajevo with representatives of political parties in Bosnia and Herzegovina, believe that the problem of amendments in electoral legislation can be resolved within the FBiH Parliament, the representatives of political parties who were at this meeting organized at the Delegation of the European Union, confirmed this to journalists in Sarajevo, but this was rejected by representatives of HDZ, and it was announced that the experts of the Commission would meet in early June with the leaders of BiH political parties.

Vice President of the Party of Democratic Action (SDA) Šefik Džaferović noted that the aim of all the meetings was that the Venice Commission determines the facts when it comes to the views of political parties on amendments to the BiH Election Law.

“The amount of controversial issues that should finally be resolved in BiH is reducing. It would be normal for the Election Law to change at the beginning of the electoral process, but in exceptional situations such as in BiH it is not excluded that this is done after the election process is opened,” he explained.

Mr. Džaferović argues that matters have been reduced to the method of filling the delegates' caucuses in the House of Peoples of the FBiH Parliament and he believes these are the issues that need to be resolved at the level of the presidents of political parties with the participation of experts from the Venice Commission.

A member of the Croat Democratic Union (HDZ) BiH presidency Lidija Bradara believes that an election law which would be contrary to the BiH Election Law cannot be adopted at the level of the Federation of BiH.

She noted that this party was in favor of implementing the judgment of the BiH Constitutional Court, but that there are different interpretations of political parties in BiH regarding this issue.

“The judgment of the BiH Constitutional Court speaks of legitimate representation. The difference is in our opinion as each party sees it in its own way. The problem in BiH is that we differently read and interpret the decisions of the BiH Constitutional Court and other judgments,” Ms. Bradara said.

After these statements coming from BiH politicians, delegate of the Democratic Front (DF) in the House of Representatives of the BiH Parliamentary Assembly, Damir Bećirović, however, said that there was no approximation of attitudes related to the amendments to the BiH Election Law, but the representatives of the parties heard some clarifications and opinions of the Venice Commission contained in the ruling of the Constitutional Court upon the appeal of Božo Ljubić.

“As stated, this problem can be solved at the entity level and there is already a law proposed by SDP and DF, which is one of the possible solutions. If the CEC adopts any decisions, they cannot be passed disregarding the FBiH Constitution, which means minimum representation and respect of the 1991 census,” he pointed out.
