Many obstacles on way to society without prejudice and discrimination in BiH

SARAJEVO, May 15 (FENA) - Coalition "Equality for All" gathered today representatives of the governmental and non-governmental sector at a conference entitled "Antidiscrimination Legislation, Policies and Practices in BiH: Achievements, Problems and Perspectives" held in Sarajevo, in the goal of creating a functional anti-discrimination system in BiH.

It was concluded that certain progress had been made, but there are still many obstacles on the way to society without prejudice and discrimination, given that the legal solutions are still inconsistent and the responsible institutions are not appropriately engaged in the implementation.

As pointed out, the Institution of Human Rights Ombudsman as a central institution for the protection against discrimination in BiH faces significant budgetary and personnel restrictions and is not in a position to fulfill all the elements of its complex mandate.

They focus mainly on the work of citizens' complaints, and the expert adviser in the Department for the Elimination of All Forms of Discrimination of the Ombudsman Institution Hajrija Adžemija told reporters that the highest number of complaints was in the field of labor and employment (mobbing is always the first on the list by the number of complaints received), followed immediately by complaints based on ethnicity.

“There is also often discrimination on the basis of ethnicity in the field of labor and employment, which can be considered as some kind of an indicator of what the key problems in our society are,” she said.

It was also underlined that the courts had not yet achieved an adequate level of capacity and knowledge to consistently apply all elements characteristic of specific anti-discrimination litigation. It was emphasized that the particular problem was the disrespect of the principle of urgency in resolving cases concerning discrimination, and the victims of discrimination’s access to the court burdened with significant administrative and financial barriers in terms of paying significant procedural costs.
