RSNA Committee opposes contesting 'RS Day', Čamdžija is optimistic

BANJA LUKA, March 29 (FENA) - At the session of the RS National Assembly’s Committee on Constitutional Affairs, the response was agreed upon to the Constitutional Court concerning the request of Bosniak delegates seeking a review of the constitutionality of the Law on "RS Day”.

The Committee’s Chairman Nedeljko Čubrilović said they expected the Court to reject this request, which was signed by eight delegates from the Bosniak Caucus and two from the Croat Caucus in the RS Council of Peoples.

Mr. Čubrilović asks why January 9 “does not have the same treatment as March 1 and why are there different explanations for marking one date in comparison to the other”.

“The RS Day is marked as a secular and not a religious holiday and treats the same way all peoples, citizens and others, regardless of ethnic and religious affiliation. The BiH Constitutional Court’s jurisdiction is being brought into question for the third time since religious holidays cannot be the subject of a constitutional court dispute. The BiH Constitutional Court should not resort to assessing the perception of historical and political facts. Diversity should not be assessed as a problem, but rather as a treasure of BiH society,” Mr. Čubrilović said.

RS Council of Peoples Deputy Chairman Kemo Čamdžija believes that the BiH Constitutional Court will decide that this is a holiday of just one people in RS, although three peoples are constitutive.

He also recalled that the Constitutional Court had earlier clearly ruled that January 9 could not be celebrated as the day of this entity.

“Some other date would have to be considered,” Mr. Čamdžija said.

Ten delegates of the RS Council of Peoples, in a request filed on January 25, ask the Constitutional Court to make a decision to declare “January 9 as RS Day” unconstitutional.

They contest the article stating that “on the basis of the confirmed will of RS citizens, January 9 is established as RS Day”.

The request was signed by eight delegates from the Bosniak Caucus and two from the Croat Caucus in the RS Council of Peoples.
