SARAJEVO, February 23 (FENA) – FBiH Parliament representative Dennis Gratz warned that the BiH Central Election Commission must explain to the public its "working material" which concerns the election of delegates to the FBiH Parliament House of Peoples, which appeared in public yesterday.
He explained that what appeared in the public does not provide insight into the complete text of the Draft Decision on the determination of the number of delegates elected from each constituent people and other peoples that are elected by the legislature of each canton.
“We do not know if the decision includes redistribution of mandates, when a cantonal assembly has representatives from peoples that are not covered by proposed cantonal quotas,” reads Mr. Gratz's statement.
He reminds of the FBiH Constitution, which is clear, and it states that the House of Peoples will have at least one delegate from each of the constituent peoples and other peoples from each cantonal assembly that has them.
“Therefore, if the assemblies of the Tuzla Canton, Una-Sana Canton, Zenica-Doboj Canton, Sarajevo Canton and Bosnia-Podrinje Canton have at least one Croat in their assemblies, then these assemblies will give at least one Croat to the House of Peoples, regardless of the ethnic structure of the population in those cantons,” Mr. Gratz said.
He added that this was not a matter of outvoting, but a guarantee of the fundamental right that every citizen can elect and be elected, only that here this constitutional principle is applied to indirect elections for delegates.
“If the CEC adopts this kind of a decision, it will directly violate the FBiH Constitution. If such a decision is adopted, the election of delegates must not begin after the election until the Constitutional Court makes the final decision on the decision itself,” Mr. Gratz concluded.
