SARAJEVO, February 21 (FENA) - All these years, after the closure of concentration camps and the non-recognition of victims by the state of Bosnia and Herzegovina through legal frameworks, the agony of former detainees continues, which undoubtedly confirms that we were victims of torture in the war and that in peace we are victims of the system, stated the Association of Detainees of Bosnia and Herzegovina.
Due to differing actions, attitudes and their changes, as well as the uneven judicial practice of the courts in BiH, former detainees, the Association said, continue to experience the torture with court judgements denying their claims for compensation of non-pecuniary damages due to alleged limitation period, and at the same time the victims are obliged to pay the costs of court fees and attorneys.
“Something like this is unprecedented in the world,” said the Association, adding that the legal terror against the victims does not seem to end.
They cited an example of Adil Šabanović, who spent two full years in prison camps of the Republika Srpska Army and experienced unseen suffering and torture together with other detainees, but managed to get out of the camps alive.
Mr. Šabanović was one of the plaintiffs for non-pecuniary damages whose lawsuit was rejected by the Court in RS and he was ordered to pay the costs of the attorney in the amount of 2,625 KM. However, Mr. Šabanović died in 2015.
In addition, the RS Attorney’s Office sent a motion for enforcement to the Municipal Court in Tuzla, requesting that Adil's son Zekerijah Šabanović pays the costs of the Attorney's Office in the amount of 2,625 KM, which his father was obliged to pay.
Then, the Municipal Court in Tuzla, at the beginning of this month, granted the request of the RS Attorney’s Office and authorized its execution.
“This is legal terror. Are the children of survivors obliged to pay a toll for their killed, tortured, illegally detained parents, as well as for the parents who managed to survive the torture of the camps and died in the meantime?” ask the members of the BiH Association of Detainees.
They urged the BiH government institutions, international institutions in BiH, and other relevant bodies to stop legal violence against former detainees.
